Dog Control Orders

For dog owners and dog walkers, the ability to exercise dogs in open areas gives great enjoyment to dogs and their two-legged friends.  However, in a seaside holiday town, St Ives Town Council is aware of the need to make a careful balance between the needs of various beach users.  Following a legal process which included full public consultation, dog control orders have been introduced which restrict dogs on the main bathing beaches between the Sunday before Easter Sunday and the end of September each year.

Notice of a Dog Control OrderNotice is hereby given that St Ives Town Council has made four separate Dog Control Orders under The Clean Neighbourhoods and Environment Act 2005 to be known as:

  1.  The Dogs Exclusion (St Ives Town Council) (Porthgwidden Beach, St Ives; Porthmeor Beach, St Ives; and Porthminster Beach ,St Ives) Order 2013;
  2. The Dogs Exclusion (St Ives Town Council) (St Ives Harbour Beach, St Ives) Order 2013;
  3. The Dogs Exclusion (St Ives Town Council) (Carbis Bay Beach, Carbis Bay) Order 2013; and
  4. The Dogs On Leads (St Ives Town Council) (Footpath from St Uny Church to Porthkidney Sands, Lelant, St Ives) Order 2013

 

The Orders will come into force on the 1st May 2013

The Dogs Exclusion (St Ives Town Council) (Porthgwidden Beach, St Ives; Porthmeor Beach, St Ives; and Porthminster Beach ,St Ives)Order will make it a criminal offence for those in charge of a dog to:

  1. Take the dog onto, or permit the dog onto, or permit the dog to enter or remain on, any land to which the Order relates (at any time from the Sunday before Easter until 30 September each year). This Order will apply to Porthgwidden Beach (St Ives), Porthmeor Beach (St Ives) and Porthminster Beach (St Ives) to which the public are entitled or permitted to have access.  Full details of the land to which this Order relates are set out in the Order and its accompanying plan.

 

The Dogs Exclusion (St Ives Town Council) (St Ives Harbour Beach, St Ives)Order will make it a criminal offence for those in charge of a dog to:

  1. Take the dog onto, or permit the dog to enter or remain on, any land to which the Order relates, between the hours of 8.00am and 7.00pm from the Sunday before Easter until 30 September each year.  This Order will apply to the Harbour Beach (St Ives) to which the public are entitled or permitted to have access.  Full details of the land to which this Order relates are set out in the Order and its accompanying plan.

 

The Dogs Exclusion (St Ives Town Council) (Carbis Bay Beach, Carbis Bay)Order will make it a criminal offence for those in charge of a dog to:

  1. Take the dog onto, or permit the dog to enter or remain on, any land to which the Order relates, between the hours of 8.00am and 5.00am from the Sunday before Easter until 30 September each year.  This Order will apply to Carbis Bay Beach (Carbis Bay) to which the public are entitled or permitted to have access.  Full details of the land to which this Order relates are set out in the Order and its accompanying plan.

 

The Dogs On Leads (St Ives Town Council) (Footpath from St Uny Church to Porthkidney Sands, Lelant, St Ives) Order will make it a criminal offence for those in charge of a dog to:

  1. Fail to keep that dog on a lead, on the land to which the Order relates (at any time). The Order will apply to the footpath from St Uny Church to Porthkidney Sands (Lelant) to which the public are entitled or permitted to have access.  Full details of the land to which this Order relates are set out in the Order and its accompanying plan.

 

The Order will allow authorised persons to serve Fixed Penalty Notices on people who breach the Order and potential prosecution of those who fail to pay a Fixed Penalty.

For Exclusion Orders only: The offence will not apply in specified circumstances concerning disabled persons.  Full details are set out in the Orders.
